This End User License Agreement ("EULA") is a legal agreement between you ("End User", "you") and Faciliti Technologies Private Limited, having its registered office at 44, 2nd Floor, Regal Building, Connaught Place, New Delhi-110001 ("FACILITI", "we", "us", "our"), governing your access to and use of the FACILITI web dashboard, mobile applications, QR/NFC interfaces, and related services (collectively, the "Services").
By accessing or using the Services, you agree to this EULA. If you disagree, please refrain from using the Services.
2.1 License via Client: You are using the Services as an Authorised User or Visitor under a Client's subscription. The Client determines why and how Personal Data is processed for its site(s).
2.2 Platform provider: FACILITI provides the technology platform and processes data on the Client's instructions. For our public website, account, billing and support, FACILITI acts as data fiduciary/controller.
3.1 Limited license: Subject to this EULA, FACILITI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services solely for lawful use at the Client's site(s).
3.2 Acceptable use: You will not:
4.1 Accuracy: You must provide accurate information and maintain the confidentiality of your credentials. You are responsible for all actions performed under your account.
4.2 Device security: You are responsible for securing your device(s), including OS updates and screen lock.
4.3 Termination of access: FACILITI or the Client may suspend or terminate your access for breach, security risk, or at the end of the Client's subscription.
5.1 Third-party identity: Where configured by the Client, identity proofing is performed through quickprism® (including quickID and DigiLocker-based verification). quickprism® is operated separately under its own terms and privacy policy.
5.2 Alias, not raw ID: FACILITI typically receives an alias/verification result and event metadata, rather than raw Aadhaar/PAN data. Real identity artefacts remain with the user/quickprism unless the Client lawfully requires otherwise.
6.1 Privacy Policy: Your use is subject to the FACILITI Privacy Policy (current version available in the dashboard/website).
6.2 Hosting location: FACILITI utilises AWS and Microsoft Azure servers, which are physically located within the Republic of India. Certain transactions may also be processed on De Nada Venture's private servers within India. No cross-border transfers are performed.
6.3 Retention model: By default, FACILITI does not store raw personal identity data on its servers. Access to personal data is secured using the quickID protocol. Within a Client's account, visit logs, incidents, audit trails, support, and billing records) remains available to the Client while the Client uses FACILITI. Upon termination, access is revoked, and data is either deleted or irreversibly anonymised by policy and applicable law.
6.4 Cookies: No marketing cookies run on the public website. The dashboard uses essential security cookies to confirm that access originates from an authorised machine.
6.5 Security: FACILITI implements encryption in transit and at rest, role-based access controls, continuous logging, and third-party assessments (including CERT-In empanelled auditors, VAPT 2025 and SAR 2025).
6.6 No selling of Personal Data: FACILITI does not sell Personal Data.
7.1 Client responsibilities: The Client is the data fiduciary for its site(s) and is responsible for notices/consents, lawful basis, retention configuration, role assignments, responding to data rights requests, ensuring data accuracy/minimisation, and notifying incidents.
7.2 Your responsibilities: You will follow site signage, lawful instructions from the Client, and this EULA; you will not collect or expose Personal Data unnecessarily (e.g., photographing logbooks or exporting data for unrelated purposes).
8.1 Support: Client administrators may use their assigned customer success channel for priority support. The client may contact [email protected] for product-related issues.
8.2 Operational messages: You consent to receive transactional/operational communications (e.g., OTP alerts, maintenance notices) via in-app messages, email, or SMS.
9.1 Ownership: FACILITI and its licensors own all rights in the Services. No rights are granted unless expressly stated.
9.2 Feedback: If you submit feedback or suggestions, FACILITI may use them without restriction or obligation.
The Services may interoperate with third-party tools (e.g., quickprism®, DigiLocker). FACILITI is not responsible for third-party services and does not control their policies.
End Users generally do not pay fees directly to FACILITI. Any pricing obligations are between FACILITI and the Client. You agree not to attempt to circumvent usage limits or settlements defined by the Client.
12.1 AS IS: To the maximum extent permitted by law, the Services are provided "as is" and "as available". FACILITI disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
12.2 No guarantees: FACILITI does not guarantee uninterrupted or error-free operation, nor does it guarantee that the Services will prevent all unauthorised access or incidents.
To the maximum extent permitted by law, FACILITI's aggregate liability to you arising out of or related to this EULA is limited to the greater of INR 10,000 or the amounts paid by the Client to FACILITI for the three (3) months preceding the event giving rise to liability, and in no event will FACILITI be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenues, data or use.
You will indemnify and hold harmless FACILITI and the Client from third-party claims arising from your unlawful use of the Services or breach of this EULA.
FACILITI may suspend or terminate your access immediately if: (a) required by law; (b) directed by the Client; (c) you breach this EULA or pose a security risk; or (d) the Client's subscription ends. Upon termination, you must stop using the Services and delete any copies of software or materials.
You may access confidential information (e.g., security procedures, non-public dashboards). You shall not disclose such information except to perform your role for the Client or as required by law.
You will comply with all applicable laws and site rules, including India's Digital Personal Data Protection Act, 2023 (DPDP). You will not use the Services for unlawful surveillance, discrimination, or harassment.
You represent that you are not subject to sanctions or restrictions that would prohibit your use of the Services and will not use the Services in violation of export control or sanctions laws.
FACILITI is not liable for delays or failures due to events beyond its reasonable control (including network or utility failures, acts of God, terrorism, labour disputes, or governmental actions).
FACILITI may update this EULA to reflect any legal, technical or business changes. The effective date/version will be updated, and any material changes will be communicated through the dashboard or website. Continued use after changes indicates your acceptance of the revised terms.
The laws of the Republic of India govern this EULA. The courts in New Delhi shall have exclusive jurisdiction. FACILITI, and you will first attempt to resolve disputes amicably. Unresolved disputes may be referred to arbitration in New Delhi, as per the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed under the Act. The language of arbitration shall be English.

This EULA is the entire agreement between you and FACILITI regarding your end-user access. If any provision is held unenforceable, the remaining provisions remain in full force.
By using the Services, you confirm that you have read, understood and agree to this EULA and the FACILITI Privacy Policy.
